To secure a booking with
AFTours the booking form and Terms and Conditions are sent to the Client. By returning the completed booking form and full payment for the tour the Client has read, understood and accepted the Terms and Conditions.
The contract is between You, the Client and
AFTours. From hereon
AFTours will be referred
to as the Company and you are referred to as the Client.
1. All written information provided to the Client is given in good faith and based on information available to the Company at time of publishing. The Client will be informed of any changes prior to the departure date if known by the Company or as soon as reasonably possible.
2. AFTours reserves the right for whatever reason to decline a booking and return payment made to the Client.
3. The full Land Only price is payable 8 weeks prior to departure. Failure to do so could result in the booking being cancelled and the seat made available to another Client. The Local Payment is payable in cash to the Tour Leader on day 1 of the tour. The Local Payment forms part of the overall tour price.
4. In the event the Client cancels his/her seat must be notified
AFTours in writing. Cancellation fees will incur if the cancellation in writing is received by
AFTours within the following timeframes;
- 56 - 42 days prior to departure – 30%,
- 41 – 28 days prior to departure – 50%,
- 27 – 14 days – 75%, 14-0 days – 100%.
5. AFTours guarantees not to increase Land Only price after the contract is made, hereby
AFTours acceptance of payment and booking form and the date of issuing notification of receipt of payment to the Client, however
AFTours reserves the right to increase the Local Payment. The Client will be informed of such increases as soon as reasonably possible.
6. AFTours reserves the right to cancel the Tour in the event there are insufficient numbers, cancellation will not occur less than 28 days prior to departure.
AFTours is not liable for any costs incurred by the Client due to the cancellation of the Tour. It is advised by
AFTours, the Client to purchase travel insurance from date of booking to cover such inconveniences.
7. In the event
AFTours cancels the Tour for whatever cause other than the fault of the Client or by reason of Force Majeure, before the departure date, the Client will have the choice of purchasing another tour or repaid sums paid by the Client pursuant to the contract. In the event after departure has occurred that changes to the itinerary are deemed necessary by
AFTours to ensure the safety and wellbeing of the Clients due to Force Majuere
AFTours is not liable for any refunds.
8. In the event
AFTours uses alternative transport not owned by
AFTours, the Client agrees that the obligation of
AFTours to Client is to select normally competent, independent sub-contractors to provide such transport and any other services related to the trip and to exercise reasonable care in selecting such suppliers to provide these services. It is understood by the Client that conditions of roads and vehicles in the countries traveling through are often of a lesser standard of those in the Western world.
9 (a) AFTours is not liable if no personal injury occurs but disruption to the overall enjoyment of the tour was adversely affected was either the Client’s fault, the actions of someone unconnected with the tour arrangements or could not have been foreseen or avoided by
AFTours or its suppliers even if all due care has been exercised. Under no circumstances will
AFTours liability for each Client under this clause exceed the tour cost paid by that Client.
9 (b) Where the Client suffers personal injury or death as a result of an activity forming part of the tour arrangements booked with
AFTours;
AFTours accepts responsibility unless there has been no fault on
AFTours part or its suppliers and the cause was either the Client’s fault, the action of someone unconnected with the tour arrangements or one which neither
AFTours nor its suppliers could have anticipated or avoided even with the exercise of all due care.
AFTours maximum aggregate liability arising from or in connection with this contract shall be limited to a reasonable sum and in no circumstances shall be greater than the tour cost.
10. Should
AFTours, due to unforeseen circumstances, change the itinerary to ensure the safety and well-being of the Client in case of or threat of Force Majeure and in so results in unplanned alternative travel arrangements such as air or sea travel to ensure the continuation of the tour;
AFTours is not responsible for any costs associated with air or sea travel. The Client is solely responsible for all costs associated from point of disembarkment from the expedition vehicle to rejoining another expedition vehicle so the tour may continue.
11. The Client is aware that where air travel forms part of the tour arrangements by scheduled carriers, their responsibility is limited in accordance with their conditions of carriage.
12. AFTours is not liable for any additional expenses incurred through delay, accident or disruption of the tour beyond the control of
AFTours by Force Majeure.
13. No party either connected or not connected to
AFTours including employee, agent or authorized representative of
AFTours has authority to commit
AFTours to any liability whatsoever.
AFTours will not be bound by any statement or representation unless it is in writing and signed by one of the directors.
14. The Client accepts that this type of travel is of the adventurous nature and carries a certain level of risk, and exposure to potential risks. The Client accepts that this is not the normal package holiday and by booking the tour accepts that they undertake all tours, treks and other activities at their own risk.
15. It is a condition of booking that Clients purchase Comprehensive Travel Insurance valid from the day of booking the tour, not from the date of departure, from a reputable Insurance Company. It is a condition of booking that the insurance is valid for all activities offered on the tour stated in the Optional Extras list provided with each and every tour offered; loss or damage to personal possessions, repatriation and medical expenses in case of illness or accident. The tour leader on day 1 of the tour will collect insurance details from the Client.
16. The Client is responsible for all personal belonging whilst on tour.
AFTours cannot be held liable for any loss or damage to personal property for any reason whatsoever.
17. The Client undertakes a) to comply with all local laws in the respective countries, b) to comply with immigration laws and be in possession of a valid passport with no less than 6 months validity; c) to comply with
AFTours policies in relation to local customs; d) to comply with all reasonable requests made by the tour leader and driver relating to local laws, customs and personal behavior of the Client; e) to comply by the terms and conditions of all carriers concerned with the actual tour. Failure to adhere by these, and if so, create unreasonable demands on the group, or endanger or inconvenience the group at any time throughout the tour; or not comply with the tour leaders reasonable demands; the tour leader may require the Client to leave the tour immediately if it is the tour leaders opinion the safety and/or well being of the group is compromised. In such cases
AFTours will not reimburse for any part of or unused portion of the tour.
18. In the event of ill health, sickness, injury or any other reason a Client cannot complete the tour no refund , either full or part unused portion, will be given by
AFTours.
19. Any Client suffering from any illness or injury must disclose the full nature of the physical or medical condition, including medication, to
AFTours prior to booking. Failure to disclose such information will result in breach of contract and forfeiting all monies paid to
AFTours.
20. Should the Client at any time commit an illegal act in the country traveling through, they will be asked to leave the tour immediately without retribution.
AFTours accepts no liability for illegal acts committed by the Client.
21. The Client understands and acknowledges that in many countries the tours travel through, the local vehicle accident insurance includes either very limited passenger liability or none at all. The Client agrees to indemnify
AFTours against any claim or demand made in respect of any accident, personal injury or loss of life caused to, contracted or suffered by the Client during the course of the tour.
22. The Client understands the prices quoted for optional extras are approximate prices only and are subject to change without prior notice. The Client accepts that this is Africa and often changes are made which are unknown and out of the control of
AFTours.
AFTours cannot be held responsible for such price changes; the Client accepts that all prices quoted by
AFTours have been given in good faith and based on the prices available at that time to
AFTours.
AFTours commits to informing the Client of such price changes at the earliest opportunity which may not be prior to the date of departure.
23. The Client is responsible for, (a) his/her air travel and transport to the location of tour departure and from the tour end point. In some cases transport from airport to location of tour departure can be arranged by
AFTours in advance at the request of the Client for a fee; (b) all visas, vaccinations and health regulation restrictions. It is compulsory for the Client to be in possession of a valid Yellow Fever certificate. All other vaccinations and malarial prophylaxis are the sole responsibility of the Client; it is recommended advice is sought through appropriate travel health care clinics in the home country prior to departure. The Client is responsible for all costs associated with air travel, visas and vaccinations. All information given to the Client about visas and visa costs is done in good faith, however
AFTours cannot be held liable for immigration or customs changes to visa restrictions or costs.
24. Should the Client be dissatisfied with the tour, tour arrangements, or any other aspect affecting their overall enjoyment of the tour. The concern/complaint in the first instance should be bought to the attention of the tour leader at the earliest opportunity. It is the tour leader’s responsibility to, in the first instance, rectify the concern/complaint. If the Client is not satisfied with the outcome the Client can submit a written complaint to
AFTours within and not exceeding 28 days from the completion of the tour. Force Majeure: Includes but is not limited to; acts of nature, weather changes, natural disasters, floods, war, threat of war, civil disturbances, government actions, riots, border closures, technical or maintenance problems with transport, cancellation of transport,or similar events which are out of the control of
AFTours.
